MANDATE

The Financial Investigator undertakes the investigative function of the Financial Intelligence Unit and is responsible for the investigations of serious financial crimes, terrorism, money laundering, the finance of terrorism and proliferation financing pursuant to the Financial Intelligence Unit Act, Revised Statutes of Anguilla, c. F26 (“the Act”) and the Proceeds of Crime Act, Revised Statutes of Anguilla, cP98 (“POCA”).

KEY FUNCTIONS

The Financial Investigator shall be responsible for the investigation of offences under the Counter Terrorism Act, 2023 No. 10/2023, Financial Intelligence Unit Act, Proceeds of Crime Act, Proliferation Financing (Prohibition) Act, 2023 No. 11/2023, and the Criminal Code and any other enactment.

The Financial Investigator is personally accountable or as a team member for the delivery of investigation casework to the Deputy Director.

The Financial Investigator shall be responsible for undertaking investigations into financial criminal matters which includes money laundering, terrorist financing and proliferation financing.

The Financial Investigator shall be responsible for undertaking investigations relevant to mutual legal assistance requests.

The Financial Investigator shall be responsible for the preparation of high quality case files for submission to the Attorney General’s Chambers in accordance with the threshold and evidential test.

The Financial Investigator shall be responsible for conducting civil recovery and criminal recovery investigations.

The Financial Investigator shall be responsible for the planning and conduct of investigations which includes suspect and victim/witness interviews; intelligence gathering; crime reduction; submit case files for prosecution and the disclosure of evidence in legal proceedings.

The Financial Investigator shall gather and use intelligence to support investigation casework, while ensuring that such intelligence is used ethically and in accordance with relevant legislation, policy, protocols, codes and practices.

The Financial Investigator shall where be necessary to provide advice and liaise with other law enforcement agencies, other departments and competent authorities to facilitate joint investigations with a view to proceed with criminal and civil recovery investigations.

The Financial Investigator shall complete administration procedures, ensuring that all processes relating to the handling of information are carried out in a prompt and efficient manner.

Any other duties commensurate with the role of a financial investigator in the FIU.
